2.3.1 Threshold(s) for when a concentration must be notified under the general merger control regime?

There is no specific merger control regime in Macau and, therefore, mergers and acquisitions are not subject to specific merger control. The general competition rules in the Macau Civil Code apply and are used to assess whether transactions, agreements and practices breach the competition rules.

The Macau Civil Code prohibits all practices or agreements whose purpose or effect is to prevent, distort or restrict competition.

There is no competition authority in Macau. Agreements and practices that are prohibited under the general legal framework are assessed by the courts of Macau.

There are certain sector-specific rules that apply to for example banks, insurance companies, gaming concessionaires and sub-concessionaires.
